706 on extension Expand / Collapse

The extended 706 return is due today. We received the information for the expenses of the estate on Saturday and have been able to finish preparing the return. When the extension was filed, an estimated amount of tax was sent in. Now the estate tax is overpaid and the trustee is unable to sign the return today. He lives out of town, we either have to FedEx the return or he must come in to sign.

Should we send it in late (no tax is due), send it without signature, or is there option 3? And do we need to include a form for request of the refund?

I have mailed in returns that have a faxed front page with the executor's signature. So that's another possibility.

If you send it in unsigned *accidentally* IRS will send ti back and request a signature. This has happened to me a couple of times. IRS has sent it to me once and to the client once.

Just filing the return is sufficient to request the refund.
