The IRS sent out a notice charging additional tax on my decedent's 2007 final income tax return due to some omitted income items. The people at the Practionioners Hot Line told me they couldn't discuss the notice with me (notwithstanding that I signed the 2007 return and was the third party designee) until I sent them Form 56 and Form 2848. I will file Form 56 showing the Executor (all assets went to a probate estate) is acting for my deceased client. It's not clear to me from the instructions for Form 56 Part V whether they want all the various probate proceedings (letters testamentary, filing inventories and accountings, etc.) or whether that info applies to some other court/administrative proceeding. In the case of my client, a copy of the letters testamentary was filed with the decedent's 2007 return, and the order for final distribution was filed 4/4/08. Does this part of Form 56 even apply to my client the decedent?

Part V is not for your situation. They need the Form 56 to be sure that it's OK for your client to sign the 2848.
