Death of first spouse and surviving spouse disclaimed interest in bypass trust within 9 months of spouses death and it was distributed to children. Do you need to disclose anything on the 706?

You will be attaching the trust agreement and will to the 706 which indicate that a Bypass trust is to be funded. Also you should attach a copy of the disclaimer, since it must be in writing. Then in the section where you list the beneficiaries, you just list the children and not the trust.

You wouldn't need an explanation of what happened since all of the documents are there, but it wouldn't hurt if you added an explanation.
