It is my understanding that in 2008 when a gross estate exceeds $2,000,000 for a married couple and one dies, that a 706 is required even though no tax is due.

A local attorney has informed me that if the estate does not exceed $4,000,000 no 706 is required.

His reference is a FAQ response.

Is there an authority for this, based on the 706 instructions it appears to be $2,000,000

The attorney might be assuming that neither of the couple had separate property.  Hence, the community half of the decedent would be $2mil.
